RETAINER FEE

I agree to be invoiced and pay a nonrefundable 20% of the total "Collection" plus "Optional Add-ons" as retainer to hold the date.

REMAINDER OF BALANCE

The Couple agrees to pay the remainder of the Contract (the “Remaining Balance”) at least thirty (30) days before the Wedding. The Couple’s failure to timely pay shall be deemed a material breach of this Contract and shall relieve the Photographer from performing any further services under this Contract.

TRAVEL FEES

All driving mileage to and from the Videographer's business address to the venue shall incur travel fees. “Travel Fees,” shall be included in the Remaining Balance unless otherwise noted. The Couple recognizes that additional mileage and travel fees may apply if they are not yet scheduled or change from the originally scheduled location. In the event Travel Fees are not included in this Contract, the Videographer shall provide a Travel Fee estimate in writing to be approved by the Couple, and the Couple shall reimburse all travel fees within ten (10) days of receipt. In the event the Videographer incurs any Travel Fees in preparation for a Wedding that is later rescheduled or deemed a Cancellation for any reason whatsoever, the Couple shall reimburse all expenses within ten (10) business days of the termination. This includes but is not limited to flights, hotel fees, rental cars, ferry fees, etc.

PLEASE READ AND ACCEPT THE TERMS OF THE FOLLOWING STATEMENTS

1. The following constitutes the Videography Agreement (the “Agreement”) of Honeysuckle Co. Media (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refers to the signer of this Agreement. Checking the boxes and entering your name below will serve as your electronic signature reflecting your assent to the terms and conditions of the Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.

2. It has been agreed that Honeysuckle Co. Media has been exclusively hired by the client as the Videographer for the specified event. The client is solely responsible for any conflicts arising due to other video coverage contracts and must notify in advance to avoid such conflicts.

3. In the event of a date change or a “Postponement” for any reason, the Couple agrees (i) to pay a “Date Change Fee” of twenty-five percent (25%) of the Total Fee, and (ii) any expenses, including but not limited to travel expenses and non-refundable and non-transferable fees are the Couple’s sole responsibility. The couple may postpone the services to a commercially reasonable date available on the Videographer’s calendar more than six (6) months but less than one (1) year from the Wedding date for a flat fee of twenty-five percent (25%) of the Total Fee. Please note that the Total Fee remains the same regardless of the size or attendance of the Event.

4. Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for Honeysuckle Co. Media each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client warrants that he/she has the legal rights to anything Honeysuckle Co. Media will videotape, including photos, musical recordings, videotapes, or any other materials delivered to Honeysuckle Co. Media for inclusion in the clients video.

5. Honeysuckle Co. Media is not responsible for poor audio if the groom and or officiant does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow camera-top lighting at the reception, or electrical or mechanical malfunctions on location that are beyond our control.

6. Honeysuckle Co. Media will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive.

7. Honeysuckle Co. Media reserves the right to use videos and photos for display/social media and or promotional purposes. All video masters, raw footage and photographs remain the exclusive property of Honeysuckle Collective.

8. Artistic Style. On its own behalf and on behalf of the subject: The client acknowledges that he/she is familiar with the Honeysuckle Co. Media portfolio and is requesting services with knowledge of the company’s style and that Honeysuckle Co. Media's work is constantly evolving; that the Honeysuckle Co. Media's services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos we shall use our own creative artistic judgment to create videos consistent with our personal judgment and consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, the client acknowledges that the videos shall not be subject to rejection based on taste or esthetic criteria.

9. If Honeysuckle Co. Media fails to comply with the terms of this agreement due to any event or at beyond the control of Honeysuckle Co. Media including but not limited to illness, accident, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Honeysuckle Co. Media's liability is limited only to a refund of all monies received.

10. The client reserves the right to terminate the contract for any reason up to 14 days after the date of down payment. Should the client terminate the contract, all money paid minus the retainer which is 20% of the total cost, will be refunded.
